Welcome to Sunny Gym, a brand name of Sunny Citrix, which owns and operates the Sunny Gym software and its backend. By visiting sunnygym.in, subscribing to, or using the Sunny Gym software ("Service"), you agree to these Terms & Conditions.

1. The Service

Sunny Gym, a brand name of Sunny Citrix, provides gym management software on a subscription basis. The Service is provided to gym owners and their authorised staff.

2. Eligibility and account

You must be at least 18 years old and legally able to enter into a contract. You are responsible for keeping your login details confidential and for all activity under your account.

3. Subscriptions and fees

• The Service is offered on monthly and yearly subscription plans, with prices displayed in Indian Rupees (INR) on our pricing page.
• Fees are payable in advance at the start of each subscription period.
• Prices may change; changes will not affect a subscription period already paid for.
• Applicable taxes, including GST, are included or added as shown at checkout.

4. Payments

Payments are processed through a third-party payment gateway. By paying, you also agree to the gateway's terms. We are not responsible for failures or delays caused by your bank or the payment gateway.

5. Renewal, cancellation and refunds

Subscription renewal, cancellation and refunds are governed by our Refund & Cancellation Policy.

6. Acceptable use

• Use the Service only for lawful gym management purposes.
• Do not attempt to copy, reverse engineer, resell or disrupt the Service.
• Do not upload unlawful, harmful or infringing content.

7. Your data

You own the data you enter into the Service. You are responsible for its accuracy and for obtaining any consent needed from your members. Our handling of data is described in our Privacy Policy.

8. Intellectual property

The Service, its design, software and branding belong to Sunny Gym. Your subscription gives you a limited, non-exclusive, non-transferable right to use the Service during the subscription period.

9. Availability

We aim to keep the Service available but do not guarantee uninterrupted operation. We may perform maintenance or updates from time to time.

10. Suspension and termination

We may suspend or terminate access if you breach these terms, misuse the Service, or fail to pay fees. You may stop using the Service at any time.

11. Limitation of liability

To the maximum extent permitted by law, Sunny Gym is not liable for indirect or consequential losses, and our total liability is limited to the fees you paid for the current subscription period.

12. Governing law

These terms are governed by the laws of India. Courts at Noida, Uttar Pradesh shall have jurisdiction.

13. Changes to terms

We may update these terms from time to time. Continued use of the Service means you accept the updated terms.
